Petitioner seeks bail in Harsidhi P.S. Case No.87 of 2019 instituted for the offence under Section(s) 414/34 Indian Penal Code.
Counsel for the petitioner submits that petitioner is in custody since 17.03.2019 having clean antecedents. He has been arrested by the police merely on suspicion.
In the written report, it is alleged that on seeing police party two persons tried to run away who have been caught and they disclosed their names as petitioner and Akhilesh Kumar Sah.
Counsel for the petitioner submits that Akhilesh
Patna High Court CR. MISC. No.37012 of 2019(2) dt.20-06-2019 2/2 Kumar Sah has already been granted bail by co-ordinate Bench of this Court by order dated 30.05.2019 passed in Cr. Misc. No.35531 of 2019.
In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, East Champaran, Motihari, in connection with Harsidhi P.S. Case No.87 of 2019, subject to the condition that both the bailors shall be close relative of the petitioner.
