JUSTICE ARVIND SRIVASTAVA ORAL ORDER 11-05-2017 Heard learned counsel for the petitioner and learned A.P.P. for the State.

Petitioner is in custody since 08.03.2016 in connection with Rupashpur P.S. Case No. 20 of 2016/ Sessions Trial No.581 of 2016 registered under Sections 302 and of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel for the petitioner has submitted that the petitioner, who is of clean antecedent, is a innocent lady and has not committed any offence. In fact, the petitioner has been made accused in this case on the basis of confession statement, in which, she herself has admitted that she has hatched up a conspiracy with the co-accused to whom she was in sweet relation with the co-accused, Avinash Kumar Bharti @ Avinash Kumar, who, having more or less similar allegation, has already been granted bail by a co-ordinate Bench of this Court in

Patna High Court Cr.Misc. No.21481 of 2017 (2) dt.11-05-2017 Cr. Misc. No. 44813 of 2016. The petitioner is rotting in custody for the last 13 months.

Considering the nature of accusation, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand rupees only) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge-VII, Danapur, Patna in connection with Rupashpur P.S. Case No. 20 of 2016/ S.T.No. 581 of 2016.
