The petitioners seek bail in Special Case No. 4415 of 2019 arising out of Phulwari P.S. Case No. 451 of 2019, instituted for the offence under Section(s) 30(a) of Bihar Excise and Prohibition Act.

It is alleged in the written report that 190 litres of foreign liquor has been recovered from Safari vehicle which was parked in the basement of Raghuwansh Apartment situated at Mitra Mandal Colony, Phulwari Sharif. It is further alleged that petitioners were found standing near the vehicle.

Patna High Court CR. MISC. No.37020 of 2019(2) dt.20-06-2019 2/2 Counsel for the petitioners submits that there is no recovery of any foreign liquor from the alleged vehicle. Petitioners were found standing near the vehicle. They have no concern with the vehicle in question. They are neither driver nor owner of the vehicle.

Petitioners are in custody since 6.5.2019 having clean antecedent.

Considering the aforesaid facts and circumstances of the case, prayer of the petitioners for grant of bail is allowed. Let the petitioners above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand each with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Patna, in connection with Special Case No. 4415 of 2019 arising out of Phulwari P.S. Case No. 451 of 2019, subject to the condition that both the bailors will be close relatives of the petitioners.
