Petitioner, already in custody, seeks bail in connection with Barachatti P.S. Case No.365 of 2008 registered under Sections 147, 148, 149, 342, 352 and 364 of the Indian Penal Code as well as under Section 17 of the C.L.A. Act. Allegation in brief is that some members of the extremist group kidnapped the son of the informant and later on he was released and returned back.

Learned counsel for the petitioner submits that the FIR is against unknown, neither the so called victim has named the petitioner nor the petitioner was put on TIP in this case. However, the petitioner has a number of antecedents and in the present case he has been in custody for last two years.

No.12418 of 2018(5) dt.12-07-2018 2/2 Having considered the aforesaid facts and circumstances, petitioner Bhim Yadav @ Hari Mohan Ji @ Lulha @ Pahadi Ful is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Sherghati, District Gaya in connection with Barachatti P.S. Case No.365 of 2008 with following conditions:

(1) One of the bailors must be the close family member of the petitioner.

(2) The petitioner shall remain physically present on each and every date before the trial court and if he absents himself on two consecutive dates without any reasonable cause, his bail bond shall liable to be cancelled.
