The petitioners apprehend their arrest in a case, registered for the offences punishable under Sections 307, 354B and other allied sections of the Indian Penal Code and section 27 of the Arms Act.

As per the prosecution case, all the petitioners entered in the house of informant and attempted to outrage the modesty of female members and in order to create terror they also fired.

It is submitted that altercation took place between the

Patna High Court CR. MISC. No.39799 of 2022(2) dt.24-11-2022 2/2 parties due to Panchayat election. Allegation is general and omnibus. Allegation of attempt of outraging the modesty is false and only with a view to make the allegation grave this allegation has been levelled.

Considering the facts aforesaid and the backdrop in which altercation took place, the petitioners above-named, in the event of their arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Samastipur in connection with Kalyanpur P.S. Case No. 339 of 2021, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
