2. Petitioner seeks bail who is in custody since 24.01.2026 in connection with Naya Bhojpur P.S. Case No. 12 of 2026, F.I.R. dated 20.01.2026 for the offences punishable under Sections 137(2), 96 and 3(5) of the BNS, 2023 and police after investigation have submitted charge sheet under Sections 137(2), 96 and 3(5) of the BNS, 2023 and Sections 4/6 of the POCSO Act.
3. According to prosecution case, this petitioner along with other accused persons have enticed away the minor daughter of the informant and this petitioner has established
Patna High Court CR. MISC. No.40063 of 2026(2) dt.29-06-2026 2/2 physical relation with her.
4. Learned counsel for the petitioner submits that petitioner has clean antecedent and he has falsely been implicated in the present case. The allegation as alleged in the FIR is false and fabricated and the petitioner has not committed any offence as alleged in the FIR.
5. The learned Additional Public Prosecutor has vehemently opposed the prayer for bail of the petitioner and submits that it appears from the impugned order that the victim was minor at the time of occurrence. Apart from that as per the allegation, the petitioner has made physical relation with the victim due to which she got pregnant and her age at that time was 15 years.
6. Considering the aforesaid facts and circumstances of the case, I am not inclined to enlarge the petitioner on bail in connection with Naya Bhojpur P.S. Case No. 12 of 2026 pending in the court of learned Additional Sessions Judge-VIcum-Special Judge of POCSO Act, Buxar.
7. Prayer is refused.
