JUSTICE SANJAY PRIYA ORAL ORDER 18-03-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Tatarpur P.S. Case No.0171 of 2016 instituted for the offence under Section 379 and 411 of the Indian Penal Code.
It is alleged against this petitioner that he came to the house of the informant on the pretext to repair the lock. Thereafter, when the informant went for preparing tea, this petitioner having opened the Godrej Almirah, took away the ornaments. The ornaments were recovered from the conscious possession of this petitioner on the same day.
A report was called for from the court below wherein it has been mentioned that charge has already been framed in this case.
Patna High Court Cr.Misc. No.7266 of 2017 (3) dt.18-03-2017 2/2 The seizure list has been enclosed with the written report which bears signature of this petitioner. Under such circumstances, this court is not inclined to grant bail to the petitioner at this stage. Accordingly, prayer for bail of the petitioner is rejected. However, the petitioner may renew prayer for bail after six months, if no substantive progress is made in the trial.
The Lower Court is directed to expedite the trial of the petitioner.
