JUSTICE VINOD KUMAR SINHA ORAL ORDER 12-04-2017 The petitioner has earlier moved before this Court for grant of bail, which was rejected vide order dated 14.02.2017 passed in Criminal Miscellaneous No.4308 of 2017, with liberty to renew his prayer for bail after framing of charge. It has been submitted on behalf of the petitioner that now charge has been framed in this case and the petitioner is in custody for about four months.
Heard learned APP also.
Having heard both sides and considering the fact that huge quantity of ganja has been recovered from the possession of the petitioner, I am not inclined to enlarge the petitioner on bail.
However the trial court is directed to expedite the
Patna High Court Cr.Misc. No.17741 of 2017 (2) dt.12-04-2017 2/2 trial of the petitioner and try to conclude the same within a period of seven months, and if the trial is not concluded within the aforesaid period, the petitioner will be at liberty to renew his prayer for bail in the court below itself.
At the same time the Superintendent of Police of the concerned district is also directed to ensure the presence of the witnesses on the date fixed so that the trial must be concluded within the time specified.
Accordingly, this application is dismissed.
