2. The petitioner seeks bail in a case registered for the offence punishable under Sections 274 and 275 of the B.N.S. and Section 30(a) of the Bihar Prohibition and Excise Act.

3. As per prosecution case, 1260 litres Nepali liquor was recovered from a pick up van of which this petitioner is registered owner.

4. It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from conscious possession of the petitioner. Petitioner has got no concern with the alleged recovery and he has been made accused in this case because petitioner is the registered owner of the seized pick up van from which the recovery has been made. Petitioner is in

Patna High Court CR. MISC. No.37704 of 2025(2) dt.01-08-2025 2/2 custody since 21.04.2025. Petitioner has got no criminal antecedents.

5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner.

6. Considering the nature of accusation, period of custody and clean antecedents of the petitioner, the prayer for grant bail of to the petitioner is allowed.

7. Accordingly, let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge-IIcum-Special Judge, Excise Act, Madhubani, in connection with Ladaniya P.S. Case No. 366 of 2024.
