JUSTICE SUDHIR SINGH ORAL ORDER 02-07-2015 The petitioner is apprehending his arrest in connection with Ayar P.S. Case No. 103 of 2014 for the offences instituted under Sections 498(A) of the Indian Penal Code and 3⁄4 of the D. P. Act.
Heard learned counsel for the petitioner and learned counsel for the State.
The prosecution story, in brief, is that the informant was married with the petitioner on 02.06.2013 according to Hindu Rites and Rituals and at the time of her marriage her father gave Rs. 1,00,000/- cash and ornament Rs. 50,000/- and after marriage she gone to her Sasural and after 3-4 months her husband alongwith other accused persons are said to have started torturing her and demanded motorcycle which has not been given at the

No.20075 of 2015 (3) dt.02-07-2015 2 / 3 time of her marriage then she reported the matter to her father regarding demand of motorcycle then her father said that he expend more money in the marriage of her daughter and he is not in position to give the motorcycle then the accused persons are started more torturing her and also said to have started assaulted her due to torture she fell ill then her brother came and she went to her Naihar with her brother and on 28.10.2014 her husband came to her house and requested to bring her and also assured that he will not demand anything and will not torture her then she came to her Sasural with her husband and after ten days again they all have started torturing and demanding motorcycle and all accused persons tied her hands and closed in a room then her father, brother came and informed the Ayar Police Station and the police came and then she gone to her Naihar.
It has been submitted on behalf of the petitioner that the petitioner being the husband of the informant is ready to keep her but the informant is not inclined for the same. It is further submitted that the petitioner is ready to deposit amount of Rs. 1,000/- each month in the court below which may be released in favour of the informant.
On behalf of the State, it has been submitted that the petitioner is named in the F.I.R.

No.20075 of 2015 (3) dt.02-07-2015 3 / 3 Considering the same, the petitioner is directed to deposit amount of Rs. 1,000/- each month in the court below which shall be released in favour of the informant, let the above named, petitioner, be released on bail in the event of his arrest or surrender before the learned court below within a period of four weeks from today in connection with Ayar P.S. Case No. 103 of 2014 on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Bhojpur, Ara, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
