JUSTICE SHAILENDRA SINGH ORAL ORDER 03-09-2025 Heard Mr. Satya Prakash Parasar, learned counsel for the petitioner, Sanjay Kumar Tiwary, learned APP for the State and Mr. Parmanand Pd. Nr. Sahi, learned counsel for the informant.

2. The petitioner apprehends his arrest in connection with Sikandra P.S. Case No. 105 of 2025 dated 15.03.2025 registered for the offences punishable under sections 191(2), 191(3), 190, 126(2), 115(2), 109, 329(4), 196, 352 and 351(2) of the Bharatiya Nyaya Sanhita.

3. The main submissions advanced by petitioner's counsel are that the petitioner bears no criminal antecedent and the specific allegation of assaulting the injured persons is against the co-accused persons, though the petitioner is alleged

No.39843 of 2025(3) dt.03-09-2025 2/3 to have pushed down the informant's daughter during the course of alleged occurrence and except this, he did not play any role in assaulting any of the injured persons and the nature of allegation against this petitioner is very simple.

On the other hand, learned counsel appearing for the informant has vehemently opposed the bail prayer of the petitioner and submits that the manner of occurrence in which the accused persons, including the petitioner, proceeded to commit the alleged offences, is in itself serious, as all the accused persons first entered into the house of the informant and thereafter assaulted four persons and during the alleged occurrence, the petitioner also threatened the prosecution party.

5. Learned APP for the State has also opposed the bail prayer of the petitioner.

6. Considering the nature of allegation appearing against this petitioner and mainly taking into account his fair and clean antecedent, this Court is inclined to grant the relief of anticipatory bail to the petitioner. Accordingly, let the petitioner named-above, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the
