JUSTICE MOHIT KUMAR SHAH ORAL ORDER 03-12-2018 After some argument, the learned counsel for the petitioner seeks liberty to file an objection under Section 9 of the Public Demand Recovery Act, 1914 and seeks direction for disposal of the same within reasonable time.
Accordingly, the present writ petition is disposed of as withdrawn with liberty to the petitioner to file objection under Section 9 of the Public Demand Recovery Act, 1914 in connection with Certificate Case No.3 of 2015-16 pending before the Court of learned District Certificate Officer, Katihar which shall be considered by the Certificate Officer and final decision shall be taken under Section 10 of the Public Demand
Patna High Court CWJC No.12109 of 2016(2) dt.03-12-2018 2/2 Recovery Act, 1914. Till the passing of the final order, no coercive steps shall be taken against the petitioner. However, it is clarified that in case no objection is filed within a period of six weeks from today, the Certificate Officer shall proceed ex.- parte.
