The petitioner seeks regular bail in connection with Nawada Town P.S. Case No. 736 of 2015 registered for the offences punishable under Sections 457 and 380 of the Indian Penal Code.
This is a case of theft of bunch of key from the room of Night Guard of Civil Court, Nawada.
Learned counsel for the petitioner submits that one Rustom Dom was arrested in another case, who confessed his guilt and admitted his complicity in committing the theft of bunch of key. The key was also recovered from possession of other co-accused. On the confessional statement of Rustom
Patna High Court Cr.Misc. No.5988 of 2017 (2) dt.22-02-2017 2/2 Dom, the name of this petitioner appeared. It further appears that nothing has been stolen from the Court or from the post office situated in the campus of Civil Court. The Postmaster has simply stated that some miscreants broke the lock and scattered the articles.
Learned APP for the State opposed the submission. Considering the fact that the name of this petitioner appeared on the confessional statement of co-accused and further that nothing incriminating materials has been recovered from his possession, the prayer of bail is allowed. The petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the each amount to the satisfaction of the learned Chief Judicial Magistrate, Nawada in connection with Nawada Town P.S. Case No. 736 of 2015.
