JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 04-01-2023 Heard learned counsel for the petitioner, learned counsel for the State and perused the case diary. The petitioner is in custody in a case registered for the offence punishable under Sections 307/34 of the Indian Penal Code and Section 27 of the Arms Act.

Allegedly, it is a case of shot fire by this petitioner upon his wife Puja Kumari due to which she sustained injury on her forehead.

Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. Petitioner is in judicial custody since 03.01.2022.

Learned APP appearing for the State has opposed the prayer for regular bail and submitted that there is direct allegation of opening fire upon the injured due to which she

Patna High Court CR. MISC. No.39720 of 2022(4) dt.04-01-2023 2/2 sustained injury. The injury report also corroborates the prosecution case.

After considering the facts and circumstances of the case, I am not inclined to grant regular bail to the petitioner. Prayer for regular bail of the petitioner is rejected. However, the trial Court is directed to expedite the trial expeditiously.
