JUSTICE VINOD KUMAR SINHA ORAL ORDER 27-08-2019 Petitioners seek bail in anticipation of their arrest in connection with Bettiah (Muffasil) P.S. Case No. 515 of 2018 registered for the offences punishable under Sections 147, 148, 149, 341, 342, 452, 323, 324, 325, 307, 379, 427 and 109 of the Indian Penal Code.

There is allegation against 21 accused persons, including the petitioners that they assaulted the informant and others.

Submission of learned counsel for the petitioners is that 21 persons are named in the FIR and no specific allegation has been attributed against the petitioners, where as specific allegation is against other accused persons and considering the

Patna High Court CR. MISC. No.38033 of 2019(3) dt.27-08-2019 2/2 same co-accused persons have been granted anticipatory bail by a co-ordinate Bench of this Court by order dated 15.2.2019 passed in Cr.Misc.No. 9181 of 2019.

In view of above facts and circumstances, let petitioners, in the event of arrest or surrender, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, West Champaran, Bettiah, in connection with Bettiah (Muffasil) P.S. Case No. 515 of 2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioners shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned.
