2. The petitioners apprehend their arrest in connection with Guthni P.S. Case No. 81 of 2020 registered under Sections 147, 148, 341, 323, 307, 354, 379, 504 and 506 of the Indian Penal Code.
3. As per prosecution case, all the F.I.R. named accused persons including these petitioners assaulted informant and his
Patna High Court CR. MISC. No.45334 of 2024(3) dt.06-08-2024 2/3 family members, as a result of which, they sustained injuries. It is further alleged that the accused persons also snatched gold ornaments worth Rs. 20,000/-.
4. Learned counsel appearing on behalf of the petitioners submits that petitioners are innocent and have falsely been implicated in the present case due to land dispute. Specific allegation of assault is against co-accused Lal Saheb. It is next submitted that the injuries allegedly caused by these petitioners are simple in nature. The First Information Report has been lodged after an inordinate delay of 15 days which creates doubt about the veracity of prosecution story. Petitioners claim clean antecedent.
5. Learned A.P.P. for the State opposes the bail application.
6. Considering the accusation, delay in lodging the F.I.R. as well as the nature of injuries allegedly caused by these petitioners, let the above named petitioners be released on bail, in the event of arrest or surrender before the learned court below within a period of six weeks from today, on furnishing bailbonds of Rs. 10,000 (Rupees Ten Thousand) each with two sureties of like amount each to the satisfaction of Additional
