JUSTICE VINOD KUMAR SINHA ORAL ORDER 07-08-2019 This is an application for grant of anticipatory bail in connection with Economic Offence P.S. Case No. 28 of 2013, disclosing offences under Sections 13(2) read with Section 13(1)(e) of the Prevention of Corruption Act, 1988. Prosecution story disclosed that a case has been instituted against the husband of the petitioner, who is Assistant Engineer Building Construction Department, Muzaffarpur Circle and he has acquired the assets in excess to the tune of Rs.2,16,87,704.30/- was found with her husband, which is disproportionate from the income of her source. Learned counsel for the petitioner drawing my attention towards the charge sheet, which shows that during the investigation, it has come on record that petitioner is a house lady.

Heard learned Senior Counsel appearing for the Economic Offence Unit, who has opposed the prayer for anticipatory bail on the ground that a conspiracy and abatement is also an offence and the husband of petitioner acquired huge property disproportionate his income, has been found. Further submission is that she has also amassed the property worth Rs.30 lakhs and abated her husband in crime.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, surrender before the court below by 14.08.2019 and on surrender, he will be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Special Judge, Vigilance, 1st, Patna, in connection with Economic Offence P.S. Case No. 28 of 2013, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure with condition that she has to co-operate in the trial and appear
