2. The petitioner apprehends his arrest in connection with Babubarhi P.S. Case No. 266 of 2022, registered for the offences punishable under Sections 366, 366(A)/34 of the IPC as well as Section 8/12 of POCSO Act.

3. As per allegation, the petitioner along with other accused persons abducted the minor daughter of the informant for the purpose of marriage.

4. The learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated. According to the medical report, the victim is about 19 years of

Patna High Court CR. MISC. No.40189 of 2025(5) dt.03-12-2025 2/2 age. She, in her statement under Section 183 of the BNSS, did not support the prosecution case. She has stated that she has solemnized marriage with the petitioner, according to her own sweet will.

5. On the other hand, the learned APP for the State has opposed the prayer for bail.

6. Considering the above-mentioned facts and circumstances, let the petitioner, in the event of his arrest or surrender within four weeks before the learned court below, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned District & Additional Sessions Judge-VI-cum-Special Judge, POCSO Act, Madhubani in connection with Babubarhi P.S. Case No. 266 of 2022, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Nawneet Kumar Pandey, J) kundan/- U T
