The petitioner apprehends arrest in connection with Bagaha P.S. Case No.53 of 2026 registered for the offence under Sections 126(2), 115(2), 109(1), 303(2), 351(2) and 3(5) of the B.N.S., 2023.

The petitioner and others are said to have assaulted the victim causing simple injury. The petitioner has three criminal antecedents.

It has been submitted by learned counsel for the petitioner that there is case and counter case between the parties and the occurrence has taken place on account of land dispute. It has also been submitted that the injury sustained by the injured is simple in nature. It has further been submitted that

Learned APP for the State has vehemently opposed the prayer of the petitioner for grant of bail. 6.

Considering the fact that the injury sustained by the injured is simple in nature and there is case and counter case between the parties, this application is allowed. 7.

Let the petitioner, above named, in the event of his arrest or surrender before the concerned Court below within four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., 1st, Bagaha, West Champaran / concerned Court below in connection with Bagaha P.S. Case No. 53 of 2026, subject to the conditions laid down in Section 438(2) of the Code of Criminal Procedure, 1973 / Section 482 of the BNSS.

As a condition of this order, the petitioner, shall mark his attendance at Bagaha Police Station, DistrictWest Champaran on first Sunday of each month. Any default in appearance at the police station will result in cancellation of bail bonds of the petitioner.

It is, however, clarified that the observations
