JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 24-06-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners and some others are named in the first information report with accusation that they mercilessly assaulted the informant's mother by means of lathi and other weapons, as a result of which the informant's mother died in course of treatment but submission on behalf of the petitioners is that only one injury was found on the head of informant's mother in course of post mortem examination and petitioners have been roped in this case on account of long standing land dispute. It is further submitted that having more or less similar allegation, co-accused Ganesh
Patna High Court Cr.Misc. No.25871 of 2016 (2) dt.24-06-2016 2/2 Yadav and Mahanand Yadav have already been granted privilege of bail.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Birpur, Supaul in connection with Birpur P.S.Case No. 207 of 2015.
