1. Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State.

2. The petitioner seeks regular bail in connection with Antichak Police Station Case No. 29 of 2020, dated 02.09.2020, registered for the offences punishable under Sections 304-B/34 of the Indian Penal Code.

3. This is the third attempt on behalf of the petitioner for grant of regular bail. On the last occasion, the prayer for regular bail of the petitioner was rejected by this Court, vide order, dated 22.02.2023, passed in Criminal Misc. No. 8242 of 2023, giving liberty to the petitioner to renew his prayer for bail after completing 31⁄2 years in custody, if the trial is not concluded within that period.

4. The prosecution case, as per the First Information Report, is that within 21⁄2 years of marriage, the petitioner, along with other family members, killed the informant's daughter due to non-fulfillment of demand of dowry. Learned counsel for the petitioner submits that the trial has not been expedited as yet despite the orders of this Court and the petitioner is in custody since 01.10.2020. He further submits that the petitioner has renewed his prayer, as observed by this Court in the order dated 22.02.2023.

5. After having heard learned Counsel for the parties and taking into consideration the fact that the petitioner has remained in custody for more than 31⁄2 years, I am inclined to grant regular bail to the petitioner.

6. This application is, accordingly, allowed.

7. Let the petitioner, above named, be released on bail, upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge XVI, Bhagalpur in connection with Antichak Police Station Case No. 29 of 2020.

8. This is subject to the condition that the petitioner shall
