The petitioner seeks bail in connection with Mohania P.S. Case No. 403 of 2016 registered under Section 302/34 of the India Penal Code and Section 27 of the Arms Act. Learned counsel for the petitioner submits that one Pintu Yadav who allegedly took away the deceased and was last seen person has been allowed bail by a co-ordinate Bench of this Court vide order dated 15.02.2017 passed in Cr. Misc. No. 5112 of 2017. The other co-accused Bhanu@ Bhanu Pratap Singh who has also been named in the F.I.R. has been allowed bail by a coordinate Bench of this Court vide order dated 22.12.2016 passed in Cr. Misc. No. 49167 of 2016. The case of this petitioner stands on better footing as there is nothing specific against him.

Patna High Court Cr.Misc. No.11775 of 2017 (2) dt.15-03-2017 2/2 Learned APP, on the other hand, opposed the prayer. Considering the facts and circumstances of the case as also the fact that nothing specific is against the petitioner, the prayer of bail is allowed. The above named petitioner is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kaimur at Bhabua in connection with Mohania P.S.
