The petitioner apprehends his arrest in Shekhopur Sarai P.S. Case No. 53 of 2022, registered for the offences punishable under Sections 419, 420 and other allied sections of the Indian Penal Code.

As per the prosecution case, this petitioner along with other accused persons cheated innocent people on the pretext of providing loan on their mobile.

It is submitted that name of petitioner transpired in this case on the basis of confessional statement of co-accused Chandan Kumar. The alleged mobile and SIM which are said to have been used in the alleged occurrence, have been recovered from the house petitioner does not belong to this petitioner

Patna High Court CR. MISC. No.40214 of 2022(2) dt.28-11-2022 2/2 rather belong to his brother. No incriminating article has been recovered from possession of this petitioner. Petitioner claims clean antecedent.

Counsel for the State opposed the prayer for bail and submitted that incriminating articles were recovered from house of co-accused Ajit Kumar who is own brother of this petitioner and ample material has come during course of investigation about the involvement of this petitioner in the alleged occurrence.

Considering the facts aforesaid, I am not inclined to enlarge the petitioner above-named on anticipatory bail. Accordingly, the same is rejected.
