Mr.Nityanand For the Opposite Party/s :

Mr.Raj Kishore Singh ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 21-06-2022 Heard learned counsel for the parties.

The petitioners apprehend their arrest in a case registered for the offence punishable under Section 307 & other allied sections of the Indian Penal Code and Section 27 of the Arms Act.

As per the prosecution case, petitioners alongwith other F.I.R. named persons are alleged to have assaulted the informant and his family members by lathi, iron rod, stones and fire-arm and thus, causing injury to altogether ten persons of

Patna High Court CR. MISC. No.49142 of 2021(2) dt.21-06-2022 2/2 the informant's side.

It is submitted on behalf of petitioners that there is case and counter case and both sides sustained injury. However, learned counsel for the informant vehemently opposed the bail petition and submitted that petitioners have brutally assaulted and caused fire-arm injury, as a result of which, four persons sustained fire-arm injury. Considering the facts and circumstances as well as nature of accusation, I am not inclined to extend the privilege of anticipatory bail to the petitioners and same is, accordingly, rejected.
