The petitioner is apprehending his arrest in connection with Baheri P.S. Case No.373 of 2013 for the offences instituted under Sections 365, 366 and 120(B) of the I.P.C. The prosecution story, in brief, is that Manisha Devi, daughter of the informant went to attend natural call along with the co-accused Pinki Kumari but Manisha Devi did not return. After some time the informant suspected that her daughter might have been kidnapped by the accused persons.
It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. The petitioner has been made accused in this case due to mistake of fact. From perusal of 164 Cr.P.C.statement made by the victim it appears that she has
Patna High Court Cr.Misc. No.43023 of 2014 (4) dt.04-09-2015 2/2 not supported the prosecution case.
On behalf of the State it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail in the event of her arrest or surrender before the learned court below within a period of four weeks from today in connection with Baheri P.S. Case No.373 of 2013 on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Darbhanga, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
