JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 20-06-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Section395 of the Indian Penal Code and under Section-25of the Antiquities and Treasure Act.

Petitioner is not named but in course of investigation, one co-accused Guddu Kumar confessed his guilt, disclosing the involvement of the petitioner in the present crime and except the aforesaid confessional statement, there appears to be nothing against the petitioner. Moreover, the stolen idol has already been recovered but not from possession of the petitioner.

Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs.
