Though, the learned lower court should not have rejected the petition for proposed amendment on the ground of having been moved after one and half years, unless and until the same happens to be barred by limitation. However, the proposed amendment (Annexure-2) is found legally deficient one. In case, the prayer is made after having properly been made meeting out the legal requirement, then in that event, the learned lower court will consider the same in accordance with law.
