The petitioner apprehends his arrest in Sonepur P.S. Case No. 500 of 2013, registered for the offences punishable under Section 392 of the Indian Penal Code.
The petitioner is not named in the FIR. The name of the petitioner figured in the case in confessional statement of Dashrath Kumar Rai from whose possession the motorcycle was recovered.
It is submitted that Dashrath Kumar Rai and Guddu Kumar were not put on Test Identification Parade and they have already been enlarged on regular bail by the learned Sessions Judge. Except the confession, no material is collected against the
Patna High Court Cr.Misc. No.20141 of 2015 (3) dt.06-07-2015 petitioner. It is a case of 392 of the Indian Penal Code and the name of the petitioner figured in the case in confessional statement. The informant has claimed to identify the accused. Hence, I am not inclined to enlarge the petitioner above named on anticipatory bail. Accordingly, the same is rejected.
However, the petitioner, if so advised, may surrender before the court below within four weeks from the date of receipt/production of a copy of this order and pray for regular bail and his prayer shall be considered and disposed of taking into consideration that similarly situated other two accused persons have already been granted bail.
