Petitioner seeks bail in a case registered for the offences punishable under Sections 498(A), 313/34 of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act. Petitioner is permitted to correct his father's name in the bail petition, as mentioned in the F.I.R. Petitioner is husband of the informant. Allegation is of demand of dowry and torture for the same to the extent of administration of medicine to get abortion of the informant. Submission is that the present F.I.R. was lodged on 13.04.2019, whereas the petitioner had lodged a case on 17.07.2018 with Sabarmati Police Station in Ahmadabad,

Patna High Court CR. MISC. No.36598 of 2019(2) dt.18-06-2019 2/2 alleging therein that wife is in illicit relationship with her covillager and was pregnant from him and has already taken medicine to ensure abortion, as such the petitioner was cheated in the marriage.

Learned counsel for the informant submits that the informant is ready for restoration of conjugal life. Allegations against the petitioner are false and concocted one. Considering the facts of this case and future chances of settlement, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with Charpokhari Police Station Case No.78 of 2019, subject to condition that both the bailors shall be resident of within the territorial jurisdiction of the learned court below and the petitioner shall fully co-operate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
