Petitioner is apprehending his arrest in a case registered in connection with Saraiya ( Jaitpur O.P) P.S.Case No. 220 of 2021 for the offences punishable under Sections , 30(a) of the Bihar Prohibition and Excise Act 2018. As per allegation in the F.I.R 1088.640 liters of foreign made liquor was recovered from Pick-up van. Learned counsel for the petitioner submits that petitioner name has been transpired on the basis of confessional statement of co-accused. Nothing has been recovered from possession of the petitioner nor he was arrested on the spot. Learned Additional Public Prosecutor opposed the bail prayer of the petitioner and submitted that petitioner has

Considering the facts, I am not inclined to enlarge the petitioner on anticipatory bail and hence, his prayer for anticipatory bail stands rejected.

Petitioner is directed to surrender before the court below and seek regular bail.
