The petitioners seek bail in Mojahidpur P.S. Case No. 94/2016, registered for the offences punishable under Sections 25(1)(a)(1-B)(a)(c), 26, 29 and 35 of the Arms Act. From the bags of Manjit Kumar petitioner no. 1, twenty semi-manufactured country-made pistol and twenty barrel of pistol were recovered. Similarly, from possession of Rahul Kumar petitioner no. 2, sixteen semi-manufactured pistol and barrels were recovered.

It is submitted that the petitioners are in jail since 26.06.2016 and petitioner no. 2 has got no criminal antecedent. Petitioner no. 1 was accused in one case, but he has already been

Patna High Court Cr.Misc. No.10949 of 2017 (3) dt.27-03-2017 2/2 acquitted.

Considering the facts aforesaid and the fact that huge quantity of arms was recovered from the bags carrying by the petitioners, I am not inclined to enlarge the petitioners abovenamed on bail at this stage. Accordingly, the same is rejected. The petitioners may renew their prayer for bail after remaining one year in custody.
