JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 05-09-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under various sections of the Arms Act. On the basis of disclosure made by the petitioner, one mini gun factory is said to be unearthed from the house of the petitioner and semi-finished firearms, other apparatus, one double barrel gun as well as cartridge were recovered from his house. Submission on behalf of the petitioner is that on the same day, two cases were registered against the petitioner. First case was registered as Mojahidpur P.S. Case No. 172 of 2015 and after that the present case was lodged by the police against the petitioner and almost similar articles were shown in different
Patna High Court Cr.Misc. No.27349 of 2016 (3) dt.05-09-2016 2/2 seizure lists. However, it is informed that petitioner has already been granted privilege of bail by this court in Mojahidpur P.S. Case No. 172 of 2015.
Considering the aforesaid facts and circumstances as well as period of detention of the petitioner in jail custody and also taking note of this fact that except the present case as well as Mojahidpur P.S. Case No. 172 of 2015, petitioner does not have any criminal antecedent, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of 6th Additional Sessions Judge, Bhagalpur in connection with Sessions Trial No. 281 of 2016 arising out of Sabour (Goradih) P.S. Case No. 176 of 2015.
