The petitioners, who are stated to be the Driver and the Cleaner of a vehicle from where 873 litres of liquor is said to have been recovered, seek bail in connection with Baisi P. S. Case No. 173 of 2020, dated 22.07.2020, corresponding to Special (Excise) Case No.

Patna High Court CR. MISC. No.36756 of 2020(2) dt.01-02-2021 2/3 295 of 2020, instituted for the offences under Sections 272 and 273 of the Indian Penal Code and Sections 30(a), 41 and 47 of the Bihar Prohibition and Excise Act, 2016.

The learned counsel for the petitioners has submitted that though the petitioners were arrested from the vehicle from where recovery of liquor has been made but they were not aware of the nature of consignment which they were asked to deliver.

They are in custody since 22.07.2020 and in the past they have not been made accused in any case whatsoever.

Considering the afore-stated facts, the petitioners, above-named, are directed to be released on bail on their furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Special Excise Judge, Purnea in connection with Baisi P. S. Case No. 173 of 2020 corresponding to Special
