JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 21-06-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Section 302 and other minor sections of the Indian Penal Code, Section 27 of the Arms Act and Section 17 of C.L.A. Act.

The alleged occurrence took place in the year 2008 and it is stated that petitioner and some other accused made indiscriminate firing causing death of informant's son. Petitioner could be remanded in this case on 29.06.2015. Submission on behalf of the petitioner is that some coaccused faced trial and got acquitted by the trial court but I am not at all convinced with the aforesaid submission and considering the previous conduct of the petitioner as well as allegation levelled

Patna High Court Cr.Misc. No.25433 of 2016 (3) dt.21-06-2016 2/2 against him, I am not inclined to release the petitioner on bail and hence, his prayer for bail in connection with Sessions Trial No. 268 A of 2011 arising out of Jhajha P.S. Case No. 225 of 2008 pending in the court of Additional Sessions Judge-II, Jamui stands rejected.
