JUSTICE DINESH KUMAR SINGH ORAL ORDER 13-03-2015 Petitioner being husband of the complainant is apprehending his arrest in a complaint case in which processes have been directed to be issued after cognizance being taken for the offences punishable under Sections 494, 498A of the I.P.C.
The basic accusations are torture and performance of second marriage.
The petitioner is not denying the performance of second marriage though submitted that second marriage was performed with consent of the complainant.
In view of second marriage the reconciliation does not appear to be feasible.
The petitioner is ready to make payment of
Patna High Court Cr.Misc. No.44616 of 2014 (2) dt.13-03-2015 2/2 Rs. 4,50,000/- to the complainant within a period of three months by way of permanent alimony.
Learned counsel for the complainant, on instruction submits that the offer is acceptable to the complainant.
Considering the present stand of the parties, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on provisional anticipatory bail for three months, on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Saran at Chapra in connection with Complaint Case No. 3121 of 2013, Trial No. 2430 of 2014.
The petitioner will deposit Rs. 4,50,000/- before learned Court below which will be released in favour of the complainant.
On deposit of the aforesaid amount the provisional bail of the petitioner will be confirmed by learned Court below.
