ANJANA MISHRA ORAL ORDER 15-05-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner has been in custody since 24.11.2017 in connection with Gaya Mufassil P.S. Case No. 191/17 registered for the offences punishable under Sections 379 of the Indian Penal Code. Later on, Section 411 of the Indian Penal Code was added.

Learned counsel for the petitioner submits that though it is alleged that the motorcycle was stolen, there was no recovery from the possession of the petitioner. It is further submitted that the F.I.R was lodged against unknown persons and the name of the petitioner has surfaced in the confessional statement

Patna High Court Cr.Misc. No.23121 of 2018 (3) dt.15-05-2018 2/2 made before the police by another co-accused which has no evidentiary value.

Taking into consideration such facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gaya, in connection with Gaya Mufassil P.S. Case No. 191/17.
