JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 21-06-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in jail custody since 14.05.2016 on the accusation that he had consumed liquor.

Contention on behalf of the petitioner is that petitioner is spoy of CRPF and, as a matter of fact, he has been implicated in this case at the behest of his enemies and even if the prosecution story is assumed to be true, then also, only 52 mg./100 ml. alcohol was detected on test by breathing analyzer.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named,

Patna High Court Cr.Misc. No.25509 of 2016 (2) dt.21-06-2016 2/2 be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria in connection with Excise Case No. 176C3 of 2016.
