This application is for grant of bail in connection with Sessions Trial No.591 of 2015 arising out of Complaint Case No.372 of 2002 for the offence under Sections 302 and 120B of the Indian Penal Code.

It is submitted on behalf of the petitioner that this is the second attempt made by the petitioner, as earlier also, prayer for bail of the petitioner was rejected but now the charges have been framed. The petitioner is in custody for about 1 1⁄2 years. There is no new material before this Court except the fact that the charges have been framed in this case.

Heard learned A.P.P. also.

No.10216 of 2017 (2) dt.20-03-2017 2/2 Having heard both sides and in view of the aforesaid facts, I am not inclined to grant bail to the petitioner at this stage, however, the learned trial court is directed to expedite the trial and try to conclude it within a period of nine months. Further, the S.P., Samastipur is directed to get the witnesses produced in the learned court below on each and every fate fixed by the court below so that the trial may be concluded within the period as stipulated by the learned court below. With the aforesaid observation, this application is dismissed.
