The petitioner apprehends his arrest in a case registered for the offence under Section 498(A), 494/34 of the Indian Penal Code and Section 3/4 of Dowry Prohibition Act. Allegation is of commission of torture and assault to the informant for dowry.

It is submitted on behalf of petitioner that petitioner is Bhaisur (elder brother of husband) of the informant and no specific allegation has been levelled against him. Petitioner is separate in mess and property and has got no concern with the affairs of couple. Petitioner has got clean antecedent. Learned counsel for the informant has opposed the prayer for anticipatory bail.

Considering the aforesaid facts and circumstances, in

Patna High Court CR. MISC. No.39829 of 2022(2) dt.28-11-2022 2/2 the event of arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Khagaria in connection with Khagaria Mahila P.S. Case No. 04 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
