The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 395, 414 and 397 of the Indian Penal Code.
The informant was robbed and assaulted by the five miscreants leading to registration of the FIR against five unknown miscreants. On next day of the occurrence the name of the petitioner sprang up in the statement of co-accused Bipul Kumar.
It is submitted by learned counsel for the petitioner that except confession of the co-accused nothing has been collected during investigation nor there is any recovery from the petitioner. A
Patna High Court Cr.Misc. No.25292 of 2016 (2) dt.21-06-2016 2/2 statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.
The impugned order reflects that the petitioner has been declared absconder and charges have been framed against other accused persons. The investigation has already concluded against the petitioner.
Let the learned court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Jandaha P.S. Case No. 191 of 2014 pending in the court of learned Additional Chief Judicial Magistrate-XI, Vaishali at Hajipur.
