JUSTICE SANJAY PRIYA ORAL ORDER 25-04-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The Petitioner seeks bail in Hajipur Town P.S. Case No. 871 of 2016 instituted for the offence under Section(s) 341, 323, 504, 307, 34 of the Indian Penal Code. It is alleged that on the date of occurrence the informant was brought to the Sessions court. The informant was talking with his lawyer, in the meantime, co-accused Arvind Gope assaulted him with fists and slaps causing injury in his eye. The petitioner also assaulted with fists and slaps on the eye of the informant. The police constables present there did not save the informant.

It has been submitted on behalf of the petitioner

Patna High Court Cr.Misc. No.14660 of 2017 (2) dt.25-04-2017 2/2 that now the compromise has taken place between the parties. From the impugned order, it appears that no serious injury has been sustained by the informant. The petitioner is said to be in custody since 05.12.2016.

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the Petitioner, above named, be released on bail on furnishing bail bond of 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Vaishali at Hajipur in connection with Hajipur Town P.S. Case No. 871 of 2016, subject to the conditions that both the bailors shall be the close relative of the petitioner. (Sanjay Priya, J) Shageer/- U T
