JUSTICE SATYAVRAT VERMA ORAL ORDER 01-02-2022 Heard learned counsel for the petitioner and learned APP for the State through video conferencing. The petitioner seeks bail in connection with Paliganj P. S. Case No.129 of 2021, instituted for the offences under Sections 384, 386, 34 of the Indian Penal Code and Sections 25(1-B)a, 26, 35 of the Arms Act.

The learned counsel for the petitioner submits that the petitioner is in custody since 06.04.2021 charge-sheet has been submitted in the case and has antecedent of three cases, but inadvertently in the bail application only two cases were mentioned and a supplementary affidavit has been filed bringing on the record one more antecedent of the petitioner. Allegation is of recovery of a loaded country-made

The learned counsel for the petitioner submits that petitioner has been falsely implicated in the case based on his antecedents. Nothing was recovered from his possession. The learned A.P.P. for the State opposes the bail application.

Considering the fact that the petitioner is in custody and charge-sheet has been submitted in the case, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Danapur, Patna in connection with Paliganj P. S. Case No.129 of 2021, subject to condition that one of the bailors shall be the father of the petitioner namely, Amrendra Sharma and in the event, if the petitioner is implicated in a case of similar nature, then the learned Court below will be at liberty to cancel his bail bonds. The application stands allowed.
