The petitioner has preferred this application for grant of regular bail in a case registered under section 30(a) of the Bihar Prohibition and Excise Act, 2016.

As per the prosecution case, 98.25 litres of liquor was recovered from the hotel in question and the accused persons including the petitioner herein were taken into custody. It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from his possession and he has been falsely implicated in the case only because of his antecedents. He is in custody since 30.3.2021 and chargesheet has been submitted in the case.

Having heard learned counsel for the parties and

Patna High Court CR. MISC. No.49213 of 2021(3) dt.30-03-2022 2/2 taking into consideration the facts of the case specially the petitioner having remained in custody for 1 year, the Court directs the petitioner to be enlarged on bail in connection with Bakhtiyarpur P.S. Case no.64 of 2021 (Special Case no.2561 of 2021) on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Barh, District Patna.
