Petitioner no.1 is the father of second wife of petitioner no.2. Petitioner no.2 is the husband of deceased. Informant, brother of deceased had arrayed motherin-law, father-in-law and petitioner no.1 to be responsible for causing death of his sister by administering poison, which is found corroborated with the FSL report.
Paragraph-7 is the statement of son of deceased. He happens to be aged about 8 years and his statement was recorded on the same day by the Investigating Officer. After perusal of the same, it is evident that he had categorically pointed out his father responsible for causing murder of his mother. That being so, I do not see it a fit case for grant of anticipatory bail. As such, prayer
Patna High Court Cr.Misc. No.6230 of 2015 (3) dt.27-04-2015 for anticipatory bail with regard to petitioner no.2, namely, Md. Khabiruddin @ Md. Khwaboruddin is rejected, though, petitioner no.1, Jardish @ Jardish Ali, in the event of his arrest/surrender within four weeks, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Purnea in connection with K. Nagar PS Case No. 343/2010, subject to the condition as laid down under Section 438(2) Cr.P.C. (Aditya Kumar Trivedi, J) perwez U T
