JUSTICE MOHIT KUMAR SHAH ORAL ORDER 05-07-2018 Heard the learned counsel for the petitioner and the learned APP for the State.

The petitioner seeks regular bail in connection with Amarpur PS case no. 527 of 2017 instituted for the offences punishable under Section 304B/34 of Indian Penal Code. The allegation against the petitioner is killing the victim lady on account of non-fulfilment of the demand of dowry. The learned counsel for the petitioner submits that the petitioner is not involved in the killing of his wife especially for the reason that he had solemnized love marriage. It is further submitted that the present case is a case of suicide and the petitioner is languishing in custody since 22.10.2017.

Patna High Court Cr.Misc. No.25402 of 2018 (4) dt.05-07-2018 2/2 I have heard the learned counsel for the petitioner and perused the case diary. I find that there are ample materials so as to make out prima facie case against the petitioner of having killed his wife, hence I am not inclined to grant regular bail to the petitioner.
