JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 10-03-2017 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in connection with Muffasil P.S. Case No. 390 of 2015, registered under Section 376 (G)/34 of Indian Penal Code, pending in the Court of Addl. Sessions Judge-7th, Begusarai.

The accusation is of committing rape by this petitioner and one Amit Kumar @ Dipla on the point of gun upon the informant. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and he is in custody since 01.12.2015.

Learned counsel for the State vehemently opposed the prayer of the petitioner.

Having considered the facts and circumstances of the

Patna High Court Cr.Misc. No.8227 of 2017 (2) dt.10-03-2017 2/2 case and nature of allegation, I am not inclined to enlarge the petitioner on bail. Accordingly, prayer of the petitioner, above named, is rejected.
