The petitioner apprehends his arrest in a case registered for the offence under Section 30(a) of Bihar Prohibition and Excise Act.

33.615 liters of foreign liquor has been recovered from the cow-shed of this petitioner.

It is submitted on behalf of petitioner that nothing has been recovered from the conscious possession of the petitioner. Recovery has been made from the cow-shed, which is open place and accessible to all. Petitioner has got clean antecedent.
