The petitioner seeks regular bail in connection with Kurhani P.S.Case No.301 of 2016, registered for offences punishable under Section 392 of the Indian Penal Code.

The petitioner is not named in the F.I.R. and his name transpired during the course of investigation. It is submitted on behalf of the petitioner that except confessional statement of the co-accused, there is nothing against the petitioner and he is in custody since 12.1.2017. It is further submitted that though the petitioner is accused in other cases also and in almost all the cases, he is on bail. It is also submitted that the other co-accused persons, whose name transpired during the confessional statement have been granted bail by this Court as

Patna High Court Cr.Misc. No.17814 of 2017 (3) dt.03-05-2017 2/2 well as by the Co-ordinate Bench of this Court, vide order dated 24.4.2017 passed in Cr. Misc. No.18436 of 2017 and order dated 30.3.2017 passed in Cr. Misc. No.15257 of 2017. Heard learned A.P.P. also, who has opposed the prayer for bail, stating that apart from the confessional statement, the petitioner is accused in five other cases.

Having heard both sides and in view of the fact that the name of the petitioner has transpired in the confessional statement of the co-accused before the police and also the petitioner is accused in five other cases also, as such, I am not inclined to grant bail to the petitioner, however, the learned trial court is directed to expedite the trial and try to conclude it within a period of nine months.

With the aforesaid observation, this application is dismissed.
