Petitioner seeks bail in a case registered for the offences punishable under Sections 414 of the Indian Penal Code and Section 20/22 of the Narcotic Drugs and Psychotropic Substances Act, 1985.

The FIR would reveal that recovery of huge quantity of narcotic drugs was made from possession of other co-accused who was travelling on the referred vehicle. Name of the petitioner surfaced in the disclosure statement of the co-accused before the police wherein co-accused stated that from the house of the petitioner, the narcotics were loaded. However, the house of the petitioner was never searched by the police thereafter. Petitioner has stated on oath that he has got no criminal antecedent. He is in custody since

The report of the trial Judge would reveal that no prosecution witness has been examined in the case after framing of the charge on 06.03.2018.

Considering the entire facts aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Special Case No. 15 of 2017 arising out of Birpur Police Station Case No. 0256 of 2017, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner as well as condition that both the bailors shall be resident of within the territorial jurisdiction of the court below.
