The petitioner seeks bail in connection with Saharsa Sadar P. S. Case No. 1089 of 2018, dated 30.09.2018, instituted for offences under Section 393 of the Indian Penal Code and Sections 25 (1-B)a, 26 and

Patna High Court CR. MISC. No.36745 of 2020(4) dt.13-04-2021 2/3 35 of the Arms Act, 1959.

It appears from the F.I.R. that the petitioner is sought to be prosecuted in this case on the basis of statement made by an arrested accused person, namely, Raushan Kumar. Aforesaid Raushan Kumar has been granted bail.

The petitioner though has been made accused in 10 other cases but in all such cases, he is on bail. This Court had called for a report from the court below about the stage of the case.

The report has since been received and it appears from the report that there is no substantial progress in this case before the court below. Regard being had to the afore-stated facts and the period of custody of the petitioner which is from 26.08.2019, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate,
